PREAMBLE & ACCEPTANCE OF TERMS

These Terms of Use and Service ("Terms", "Agreement") constitute a legally binding contract between IVIRTH ("Company", "we", "us", or "our") and any individual, institution, tutor, mentor, creator, or entity ("User", "you", "your") accessing, registering with, or utilizing the platform, products, and services hosted under The Great Indian Campus across ivirth.com, related subdomains, web portals, APIs, and associated mobile applications (collectively, the "Platform").

By creating an account, clicking "I Agree", executing a commercial order, or browsing the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with our [Privacy Policy], [Community Guidelines], and [Refund & Cancellation Policy]. If you do not agree to these Terms in their entirety, you must not access or use the Platform.

1. REGULATORY COMPLIANCE AND LEGAL CAPACITY

1. Governing Law Framework: These Terms are published and executed in compliance with:
   
   
   
   • The Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as an electronic record and electronic contract).
   
   
   • The Digital Personal Data Protection Act, 2023 (DPDPA).
   
   
   • The Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.
   
   
   • Guidelines and regulatory benchmarks outlined in the National Education Policy 2020 (NEP 2020) concerning academic integrity, digital literacy, and educational equity.
   
   
   
   


2. Contracting Eligibility: You affirm that you are at least 18 years of age and fully competent to enter into the terms, conditions, obligations, and representations set forth herein.


3. Minors and School Learners: If you are under the age of eighteen (18) years ("Minor"), you may only use the Platform under the direct supervision of and with the verified consent of a parent or legal guardian. The parent or legal guardian assumes full legal and financial responsibility for all activities conducted by the Minor on the Platform. IVIRTH strictly adheres to Section 9 of the DPDPA, 2023, prohibiting detrimental behavioral tracking or targeted commercial profiling of minors.

2. THE ECOSYSTEM: SCOPE OF SERVICES

The Great Indian Campus operates a multi-disciplinary infrastructure integrating academic delivery, interactive networks, digital/physical commerce, and autonomous technological tools:

• The Academic Engine: Multi-tenant Learning Management Systems (LMS), public/private/live broadcast courses, modular course bundles, subscription-based learning programs ("Subscribe & Learn"), automated digital/physical attendance tracking, continuous assessments, assignments, quizzes, and credentialing/certifications.


• Interaction & Community: One-on-one and cohort-based mentorship, video meetings, webinars, public and encrypted 1-1 chat rooms, open discussion forums, and a centralized Finder Directory (indexing mentors, institutions, academies, and tutors).


• Commerce & Opportunities: Virtual and physical marketplace storefronts, flexible installment payment facilities, gifting mechanisms ("Gift Club"), research and book publishing infrastructure ("Publish with Us"), event ticketing/logistics, and job/internship boards.


• Gamification & Ecosystem Growth: Milestone rewards, institutional points clubs, and network-driven affiliate/referral commission architectures.


• Advanced Infrastructure: Sovereign identity and decentralized portfolio management ("Helix Identity & Branding System"), algorithmic performance analytics ("VISE Metric & Growth System"), built-in generative AI tools ("AI Content Generator"), custom institutional machine learning deployment ("Create Your Own AI"), and dedicated customizable tenant web/app storefronts.

3. ACCOUNT REGISTRATION, SECURITY & HELIX IDENTITY

1. Authentication: Access to specialized Platform modules requires registration. You agree to provide true, accurate, and current credentials during onboarding.


2. Helix Identity & Sovereign Data Ownership: The Platform implements the Helix Identity System, conferring sovereign control over academic and creator credentials to the user.
   
   
   
   • You retain verifiable ownership of your issued credentials, portfolio artifacts, and digital achievements.
   
   
   • You are solely responsible for maintaining the confidentiality of your cryptographic keys, access tokens, and passwords linked to your Helix identity.
   
   
   • IVIRTH is not liable for irreversible losses arising from compromised private keys or authentication tokens maintained exclusively on the user side.
   
   
   
   


3. Organizational Accounts: Where access is provisioned through an educational institution, enterprise, or university under our Organizational Education System, you acknowledge that the designated institutional administrator exercises supervisory administrative authority over your institutional tenancy, course allocations, and academic reports.

4. ACADEMIC INTEGRITY, ATTENDANCE & CERTIFICATIONS

1. Honesty and Originality: All work submitted via assignments, quizzes, dissertations, and examinations must be the original product of the submitting learner. Plagiarism, impersonation, unauthorized AI-generated submissions where human authorship is mandated, and contract cheating will result in immediate disqualification without refund.


2. Attendance System: The Platform integrates automated tracking for both virtual sessions and physical classroom environments.
   
   
   
   • Circumventing digital attendance through proxies, automated scripts, or fraudulent location spoofing constitutes a material breach of these Terms.
   
   
   • Attendance records synchronized from physical institutional touchpoints are conclusive evidence of participation for accreditation and compliance purposes.
   
   
   
   


3. Certifications & NEP Alignment: Digital certificates and micro-credentials issued by IVIRTH or its partner institutions represent milestone completion. Issuance is contingent upon satisfying attendance minimums, passing grades, and identity verification. Certificates are cryptographically stamped under the Helix system. IVIRTH does not guarantee employment, academic credit transfers, or degree equivalencies unless explicitly partnered with a recognized statutory university or board under NEP/UGC/AICTE mandates.

5. INTERACTIVE SPACES, MENTORSHIP & INTERMEDIARY OBLIGATIONS

1. Intermediary Status: With respect to public chat rooms, discussion forums, open webinars, and creator storefronts, IVIRTH operates as an intermediary under Section 79 of the Information Technology Act, 2000. We do not initiate the transmission, select the receiver, or modify user-generated content, except under lawful moderation.


2. Mentorship & Tutors (Finder Directory): The Finder Directory provides direct connections between learners, independent tutors, and institutions.
   
   
   
   • Mentors and tutors operate as independent contractors, not employees or agents of IVIRTH.
   
   
   • IVIRTH performs baseline platform validations but does not guarantee the subjective outcome of independent mentorship sessions.
   
   
   • Users are advised not to share unencrypted personal financial details or off-platform communication channels during mentorship interactions.
   
   
   
   


3. Prohibited Content (Rule 3(1)(b), IT Rules 2021): Users shall not host, display, upload, modify, publish, transmit, store, update, or share any information that:
   
   
   
   • Belongs to another person and to which the user does not have any right;
   
   
   • Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, or encouraging money laundering or gambling;
   
   
   • Infringes any patent, trademark, copyright, or other proprietary rights;
   
   
   • Deceives or misleads the addressee about the origin of the message or knowingly communicates any misinformation;
   
   
   • Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign States, or public order.
   
   
   
   

6. COMMERCE, PAYMENTS, SUBSCRIPTIONS & CANCELLATIONS

1. Pricing & Taxes: All prices listed on the Store & Marketplace, course catalogs, and ticketing tools are in Indian Rupees (INR) unless otherwise stated, inclusive of applicable Goods and Services Tax (GST).


2. Subscribe & Learn (Subscriptions): Subscription tiers grant non-exclusive, revocable, non-transferable access to specified learning libraries for the chosen billing cycle (monthly, quarterly, annual). Subscriptions auto-renew unless cancelled at least 24 hours prior to the renewal date via your account dashboard.


3. Installment-Based Payments: Where flexible installment pathways are utilized:
   
   
   
   • You commit to satisfying the complete amortization schedule.
   
   
   • Failure to pay subsequent installments on due dates may result in immediate suspension of course access, credential withholding, and legal recovery of outstanding dues.
   
   
   
   


4. Physical & Virtual Marketplace:
   
   
   
   • For physical merchandise, title passes upon delivery to the carrier. Shipping schedules are estimates.
   
   
   • Digital assets, software packages, and virtual materials are licensed, not sold, and become immediately accessible upon payment completion.
   
   
   
   


5. Refunds: Due to the direct and irrevocable delivery of digital learning assets, courses and subscriptions are generally non-refundable once accessed, except where explicitly mandated by consumer protection regulations or outlined in a program-specific service-level agreement.

7. INTELLECTUAL PROPERTY & "PUBLISH WITH US"

1. Platform IP: The design, source code, UI/UX, software engines, trademarks, logos, algorithms, and documentation associated with ivirth.com, the Helix Identity System, and the VISE Metric system are the exclusive proprietary property of IVIRTH.


2. Publish with Us (Authors & Creators):
   
   
   
   • Authors, researchers, and creators utilizing our publishing platform retain underlying moral and legal copyright over their submitted research, books, manuscripts, and original media.
   
   
   • By submitting content via Publish with Us, you grant IVIRTH a worldwide, royalty-bearing (as per commercial publishing schedules), sublicensable license to host, print-on-demand, digitally distribute, index, and market the publication across designated channels.
   
   
   • You warrant that your published work is original, does not infringe any third-party IP, and contains no plagiarized, libelous, or unlawful matter.
   
   
   
   


3. Student Work: Learners retain intellectual property over their independent creative projects, dissertations, and codebase assignments, granting IVIRTH a non-exclusive license solely to host, evaluate, and archive the work for institutional assessment purposes.

8. ARTIFICIAL INTELLIGENCE TOOLS & ETHICAL GOVERNANCE

1. AI Content Generator: Educators and creators utilizing the built-in Generative AI engine acknowledge that AI-generated materials must be fact-checked and reviewed by a human instructor prior to pedagogical deployment. IVIRTH does not warrant that AI-generated answers, quiz drafts, or course outlines are free of hallucination or pedagogical error.


2. Create Your Own AI: Institutions and creators who build, configure, or train custom AI models via the Platform agree that:
   
   
   
   • They possess all necessary rights, licenses, and consents for any proprietary data used to fine-tune or train the model.
   
   
   • Custom AI models must not be designed to generate malicious code, academic fraud materials, deepfakes, or defamatory content.
   
   
   • IVIRTH reserves the right to terminate or isolate any custom model generating outputs that violate Indian law or platform policies.
   
   
   
   


3. VISE Metric System: Telemetry gathered through the VISE system is used to assess learning equilibrium, engagement rhythm, and community harmony. Users agree not to reverse-engineer, artificially manipulate, or deploy automated bots to spoof VISE governance metrics.

9. GAMIFICATION, REWARDS & AFFILIATE SYSTEM

1. Reward & Points Club: Points, virtual badges, and platform credits accrued through learning milestones or community engagement have no direct legal tender status, cannot be exchanged for cash outside designated platform redemption mechanisms, and expire upon account abandonment or termination.


2. Affiliate & Referral System:
   
   
   
   • Participants must adhere to ethical marketing practices. Spamming, deceptive promotions, or bidding on trademarked IVIRTH/Great Indian Campus terms in search engines is strictly forbidden.
   
   
   • Referral payouts are disbursed subject to tax deductions at source (TDS) under the Indian Income Tax Act, 1961, and require valid PAN/KYC submission prior to release.
   
   
   
   

10. CAREER SERVICES & JOB BOARDS

The Platform’s Job Board facilitates connections between verified students, certified alumni, and hiring partners. IVIRTH acts solely as an introductory venue. IVIRTH:

• Does not guarantee employment, interview offers, or salary thresholds.


• Does not control the hiring practices, background verification standards, or working conditions of third-party employers.


• Mandates that employers must not charge application fees or recruitment deposits to candidates; any such demands must be reported immediately to grievance@ivirth.com.

11. SUSPENSION, TERMINATION & HELIX REVOCATION

1. Termination by User: You may deactivate your account at any time via settings, provided all outstanding installment obligations and commercial settlements are fulfilled.


2. Termination by IVIRTH: We reserve the right to suspend, throttle, or terminate your access immediately, without prior notice, if:
   
   
   
   • You commit a material breach of these Terms, the Privacy Policy, or Community Guidelines.
   
   
   • You engage in academic malpractice, system intrusion, harassment, or financial fraud.
   
   
   • Mandated by a court of competent jurisdiction or law enforcement order.
   
   
   
   


3. Post-Termination Status: Upon termination, your access to active courses, private communities, and subscription libraries ceases immediately. Immutable sovereign credentials issued under the Helix Identity System prior to termination remain cryptographically verifiable, but platform-hosted references may be marked as deactivated.

12. DISCLAIMERS & LIMITATION OF LIABILITY

1. "As-Is" Provision: The Platform and its entire content are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including fitness for a particular educational purpose, uninterrupted server uptime, or non-infringement.


2. Limitation of Liability: To the maximum extent permitted by applicable Indian law, IVIRTH, its directors, employees, affiliates, and partners shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of profits, data, goodwill, or career opportunities, arising out of your access to or inability to use the Platform.


3. Monetary Cap: In no event shall IVIRTH’s total aggregate liability arising from all claims related to the Platform exceed the total amount actually paid by you to IVIRTH for the specific course, service, or product giving rise to the claim during the six (6) months preceding the incident.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless IVIRTH, its subsidiaries, officers, directors, agents, mentors, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including legal fees) arising from:

• Your violation of any provision of these Terms or applicable statutory laws.


• Any content, research manuscript, or media you post, publish, or market through Publish with Us or creator storefronts.


• Infringement of any intellectual property, privacy, or publicity right of any third party caused by your custom AI models or course materials.

14. DISPUTE RESOLUTION AND JURISDICTION

1. Informal Resolution: In the event of any controversy, claim, or dispute arising out of or relating to these Terms, the parties shall first attempt to resolve the matter in good faith through direct consultation via the Grievance Officer.


2. Arbitration: Any dispute not resolved informally within forty-five (45) days shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, or failing agreement, appointed by the appropriate High Court. The seat and venue of arbitration shall be Lucknow, Uttar Pradesh, India, and proceedings shall be conducted in English.


3. Courts and Jurisdiction: Subject to the arbitration clause, the courts of competent jurisdiction situated in Lucknow, Uttar Pradesh, India, shall have exclusive jurisdiction over all matters arising under or in connection with these Terms.

15. GRIEVANCE REDRESSAL & NODAL OFFICER CONTACT

Pursuant to Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the provisions of the Digital Personal Data Protection Act, 2023, the details of the Grievance Officer are set forth below:
